It’s official. Ecojustice is taking the fight to defend endangered Southern Resident killer whales from the Trans Mountain project all the way to the Supreme Court of Canada. And we’re counting on your support.
Only 73 Southern Residents remain, struggling to survive against multiple threats. Yet the Federal Court of Appeal decided not to hear our most recent challenge of the Trans Mountain pipeline expansion. In fact, it decided not to hear any environmental legal arguments on the federal Cabinet’s decision to re-approve this risky project.
We believe the court made a mistake. Now, we’re asking the highest court in Canada to hear our appeal.
Supreme Court cases can be game changers, and this is no exception. Unless the Supreme Court overturns the decision, there will be no way to enforce the laws put in place to protect at-risk species — such as the Southern Residents — from projects like the Trans Mountain expansion.

Southern Resident killer whales are already at their absolute limit when it comes to coping with ocean noise, vessel disturbance, and the existing food shortage. Increased threats from the Trans Mountain pipeline expansion will push these iconic whales even closer to extinction.
If built, Trans Mountain will also lock us into decades of fossil fuel consumption when we are in the middle of a climate crisis. Let’s be clear: The government can put Canada on the path to a safe climate future and protect endangered orcas or it can push this pipeline through. It cannot do both.
