OTTAWA/TRADITIONAL, UNCEDED TERRITORY OF THE ALGONQUIN ANISHNAABEG PEOPLE — On Monday, November 18, environmental and Indigenous organizations will be at the Federal Court of Appeal in Ottawa to challenge the approval of the Bay du Nord oil and gas project in court. This legal challenge addresses the Minister of Environment and Climate Change’s April 2022 decision to greenlight the $16-billion offshore development proposed off Newfoundland and Labrador’s coast.
The appeal, filed by Ecojustice on behalf of Sierra Club Canada Foundation and Mi’gmawe’l Tplu’taqnn Inc., follows an earlier Federal Court dismissal of their initial case. The groups argue that the Canadian government has failed to assess a crucial aspect of the project, the shipping of oil through Indigenous fishing grounds, and uphold Indigenous consultation rights.
This case seeks to set a critical legal precedent regarding environmental assessment standards for fossil fuel projects and the protection of Indigenous rights.
